By accessing the 'Service', you accept, without limitation or qualification, all of the Terms and Conditions in this user agreement. Yorkshire Craft Beers can change these Terms and Conditions at any time. The changes will appear on this screen. By using the 'Service', you agree in advance to accept any changes.

The 'Service' contains information, facts and opinions from various individuals and organisations. Yorkshire Craft Beers ('We') at Queens Mill, Aire Street, Castleford, WF10 1JL offer alcoholic beverages for sale to consumers through this website. All orders placed through this website will be subject to the terms and conditions set out on this website. By placing an order you are deemed to have accepted these terms and conditions. Please read them before placing your order and if you don't agree to these terms and conditions then you must stop using the website immediately.

CUSTOMERS

It is illegal for anyone under the age of 18 years old to purchase alcoholic beverages in the UK. You may be required to supply proof of age on request and we shall not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. You must be over 18 years of age and capable of entering into a contract and by placing an order you confirm this.

PRODUCTS

We acknowledge the requirement to supply the goods in accordance with the order placed. We reserve the right to alter, without notice, prices of products and conditions of sale before you place an order. Prices displayed are for a single item unless otherwise stated. Product colours may vary from the images displayed on this website. We reserve the right to withdraw any item from sale without notice. Whilst every effort is made to ensure product stock levels are correct it may happen that we are unable to fulfil an order, if this happens we will contact the customer to discuss options.

ALLERGENS

All beers sold contain Gluten unless stated. Some beers contain lactose and nuts. While every effort is made to display the correct dietary allergens on this website it is the responsibility of the customer to ensure any products purchased are suitable for consumption. Please contact us if you need more information.

PAYMENT

Full payment must be made prior to the dispatch/collection of your order. We cannot accept liability for any losses or costs incurred or sustained by customers who transmit payment information. We only accept Pounds Sterling GBP (£). Prices displayed are inclusive of VAT at the current UK rate. By placing an order you are confirming that the method of payment used belongs to you.

STORAGE

All beers purchased must be stored in a fridge to prevent second fermentation that can be caused by incorrect storage. Yorkshire Craft Beers are not responsible for any damages or loss caused by incorrectly stored products.

SHIPPING

We only deliver to mainland UK addresses (excluding the Scottish Highlands) The price is £6.95 unless you spend £70.00 or more, then you qualify for FREE shipping (payment by Gift Card excluded). There is a minimum spend of £15.00 on products. We use a next working day service, excluding weekends and public holidays. To qualify for next day delivery your order must arrive before 1pm on a Monday, Tuesday, Wednesday and Thursday. Parcels are tracked and the customer will receive an email from our courier APC about their delivery. The person who accepts delivery must be over 18 years old. Parcels cannot be delivered without a signature. If your parcel is returned to us by APC because delivery could not be carried out for any reason the customer must pay the £6.95 shipping fee to receive their order even if their order qualified for free shipping.

RETURNS

Return the goods with the original packaging intact to the address below without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from the contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

All returned parcels must be sent back using Recorded Delivery and adequately packed to avoid any possible damage in transit. We cannot accept responsibility for goods damaged during their return, or for postal or other costs incurred when returning goods.

Some of our products are fragile and, whilst every care will be taken to deliver the goods safely, inevitably some breakages may occur. In this event please contact us immediately and we will resolve any issues.

CANCELLATION

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the courier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement. If you cancel this contract we will issue a full refund, including the cost of delivery, using the same means of payment as you used for the initial transaction. We may make a deduction from the refund for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will issue the refund the without undue delay, and not later than:

a) 14 days after the day we receive back from you any goods supplied, or
b) (if earlier) 14 days after you provide evidence that you have returned the goods, or
c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

GOVERNING LAW

These terms shall be governed by and construed in accordance with English Law and all parties shall submit to the exclusive jurisdiction of the English Courts.

LIMITATION OF LIABILITY

We shall not be liable to pay any compensation to you, other than any refund as provided above. In particular, but without limitation, we shall not be liable to you for loss of profit, damage to goodwill, any indirect or consequential loss or damage arising out of any damage, defect, negligence or other failing on our part unless:

a) you have expressly made us aware in writing of the nature and extent of the loss or damage which may suffer in such situation and
b) we have expressly confirmed in writing that we accept liability for such matters.

Nothing in these terms shall limit any rights you may have as a customer which are not capable of being lawfully excluded or limited, nor shall it exclude or restrict our liability to you for any death or personal injury resulting from our negligence.

INDEMNITY

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or personal information.

OUR RIGHTS

We reserve the right to:

a) modify or withdraw, temporarily or permanently, this website (or part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to the website; and/or
b) change these terms and conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether these terms and conditions have been changed.

REFUSAL OF TRANSACTION

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To secure your event date the room hire fee of £150 must be paid within 7 days of confirming your booking and is non-refundable.

If applicable, the bar cover fee is £200. The minimum spend in bar sales (hire fee excluded) is £500. If we take £500 or more the client will have their bar cover fee refunded in full. If the bar sales are less than £500, the difference will be taken from the bar cover fee up to a maximum of £200 and the remainder of the bar cover fee, if any, will be refunded. Bar cover fee must be paid a minimum of 14 days before your event takes place. If your event is cancelled the bar cover fee will be refunded within 28 days of the cancellation date.

The hirer, not being a person under 18 years of age, hereby accepts responsibility for being in charge of and on the premises at all times when the public are present and for ensuring that all conditions, under this Agreement, relating to management and supervision of the premises are met.

Guests are not permitted to consume their own drinks. This is a licensing condition for which we retain responsibility. We reserve the right to confiscate unauthorised drinks or remove them from the premises.

Guests that appear to be under 25 years of age will be challenged for photo ID in an acceptable format. Acceptable formats include driving licenses, passports or pass approved ID cards.

The right to admission to an event is reserved by Yorkshire Craft Beers and event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion, and may from time to time carry out security searches.

No refunds will be offered to those who are refused entry or ejected on account of late arrival, being (or appearing to be) under age, abusive, threatening, drunken or other antisocial behaviour, carrying offensive weapons or illegal substances.

If the event is cancelled or postponed, Yorkshire Craft Beers cannot be held responsible for any costs incurred by the customer for travel, accommodation, or any other related service.

Yorkshire Craft Beers reserve the right to cancel any booking giving at least 28 days notice to the client, in this instance all fees paid will be returned to the client.

Hirers are able to decorate the rooms to their own specifications, provided no damage is done to the fabric of the building. The use of paper, plastic or foil confetti is not allowed for environmental and hygiene reasons.

The hirer shall, if preparing or serving food, observe all relevant food health and hygiene legislation and regulations.

The client is responsible for returning all the rooms used for their event to us in an undamaged, clean and tidy state, if this is not the case the client will incur additional charges to rectify any issues.

We cannot guarantee that the food and/or drink served at our events are free from foodstuffs that can cause allergic reactions in persons who suffer from food allergies unless specified as such.

To secure your event date the bar hire fee/deposit must be paid in full within 7 days of confirmation of your booking and is non-refundable.

Guests are not permitted to consume their own drinks. This is a licensing condition for which we retain responsibility. We reserve the right to confiscate unauthorised drinks or remove them from the premises.

Special requests for specific drinks must be made at least 28 days prior to your event date.

Yorkshire Craft Beers is responsible for the operation of your bar in accordance with the licensing act 2003. This means that the premises used for the event, including marquees or private houses, will have been licensed to permit the retailing of alcohol for the duration of the event and the licensing law will be in operation. If no such license exists for the premises the bar will not be permitted to open. A copy of the license must be provided at least 1 month before the event date.

Guests that appear to be under 25 years of age will be challenged for photo ID in an acceptable format. Acceptable formats include driving licenses, passports or pass approved ID cards.

Yorkshire Craft Beers reserve the right to cancel any booking giving at least 28 days notice to the client. In this instance all fees paid will be returned to the client.

The client will be required to ensure that we have access to the venue at the time we agree which must be at least 2 hours before the event starts. You must inform us in advance if there are restrictions to the venue access such as time restrictions, parking restrictions or car parking height restriction. If the client requires us to setup the bar at any other time than 2 hours before the event starts then extra fees will be incurred.

Pre-paid bar fees must be paid at least 28 days before the event date and are non-refundable unless the client cancels their event more than 28 days from the event date, in which case the pre-paid bar fees will be refunded in full.

Bar cover fees, if applicable, must be paid at the time of booking and are refundable in full, part or not at all, dependant on the agreed amount being taken by us at your event.

We cannot guarantee that the food and/or drink served at your event are free from foodstuffs that can cause allergic reactions in persons who suffer from food allergies unless specified as such.

To secure your wedding reception date a non-refundable deposit of £250 must be paid within 7 days of your booking confirmation. The balance is payable 1 month before your wedding reception date and is non-refundable after is has been paid.

Yorkshire Craft Beers, The Castleford Heritage Trust and the Queens Mill wedding venue in Castleford does not have a license to carry out a legally binding wedding ceremony as defined in UK law.

The Loyalty Card will receive a single stamp for every single transaction of £30 or multiples of £30, e.g. spend £60 and receive 2 stamps, spend £90 and receive 3 stamps etc.

Online orders that require shipping and drinks/snacks bought for consumption on the premises are not eligible for Loyalty Card stamps.

Transactions made by more than 1 person cannot be combined to receive stamps.

The Loyalty Card must be presented at the time of the transaction or collection for Click N Collect orders. If you don't have your Loyalty Card it cannot be stamped at a later time but we will issue a new Loyalty Card with stamps if applicable.

The Loyalty Card must have 6 stamps to be redeemed. When the Loyalty Card is redeemed the customer will get £10 off that purchase. Loyalty Cards can only be redeemed on in-store purchases.

Click N Collect customers will receive stamps when they collect their order if applicable.

Only 1 Loyalty Card can be redeemed on a single transaction. The customer cannot redeem the Loyalty Card on the transaction or the day that received the 6th stamp.

The Loyalty Card has no cash value and no change will be given.

When a customer redeems a Loyalty Card they only get stamps on their new Loyalty Card for that transaction if the order value is a minimum of £10 above multiples of £30 i.e. £40 for 1 stamp, £70 for 2 stamps, £100 for 3 stamps etc.

Lost Loyalty Cards with stamps cannot be replaced with the stamps previously accumulated.

Yorkshire Craft Beers reserve the right to make changes or cancel the Loyalty Card scheme at any time.

Once purchased, ticket payments cannot be refunded under any circumstances unless the event is cancelled or moved to another date.

It is the customer's responsibility to check whether the event is going ahead on the scheduled date, time and venue.

If the event is cancelled or postponed, Yorkshire Craft Beers cannot be held responsible for any costs incurred by the customer for travel, accommodation, or any other related service.

Customers are aware that amenities advertised by Yorkshire Craft Beers are not guaranteed and are not grounds for a refund, although every effort is made to ensure the event is as advertised.

Gift Cards are only redeemable on our website to buy products online.

Gift Cards are not a physical object, they are a unique code included in your email.

Gift Cards are valid for 6 months from the date of purchase.

Gift Cards do not qualify for FREE shipping.

Gift Vouchers are only redeemable at our shop in Castleford and can only be used in exchange for products and have no cash value.

Gift Vouchers are valid for 6 months from the date of purchase.

Gift Vouchers cannot be used to make purchases on our website, vouchers bought for this purpose must be returned to us before we issue a refund which will be minus £1.95 paid for P&P and Paypal fees we incurred.
